The agreement
These terms apply when you engage Pixaloom Tech AI to produce advertising creative, and when you use this website. By sending us a brief and accepting a quote, you agree to them.
Where we have signed a separate written agreement with you, that agreement wins wherever the two conflict.
What we provide
We produce AI-generated video advertising — scripts, hooks, scenes, voiceover, captions and exports — from a brief you supply, and deliver the finished files to you.
- We deliver files. We do not manage your ad account, place media, or spend budget on your behalf.
- We do not publish anything to your social accounts. You upload the work yourself.
- The scope of any engagement is what is written in the quote you accepted.
Your responsibilities
- Rights in what you send. You confirm you own, or are licensed to use, every photo, clip, logo, trademark and piece of copy you give us, and that we may use them to make your ads.
- Truth of your claims. You are responsible for the accuracy of claims about your product — prices, offers, results, ingredients, certifications. We write to the brief; we cannot verify your business.
- Platform and advertising law. You are responsible for making sure the finished ad complies with Meta's advertising policies and the advertising, consumer-protection and sector rules that apply to you before you run it.
- Approval. Nothing goes live unless you decide it does. Review what we deliver before you spend money behind it.
About AI-generated content
Our work is produced with generative AI. You should understand three things about that:
- Generated people are not real people. They are not actors, customers or endorsers, and the ads must not present them as real testimonials.
- Generated imagery is not unique in the way a photograph is. Similar prompts can produce similar results for other people, and we cannot promise exclusivity over a generated look.
- The legal position on copyright in AI-generated material is still developing in India and elsewhere. We assign you whatever rights we hold, but we cannot guarantee a court will treat purely machine-generated frames as protectable.
Where a campaign needs guaranteed exclusivity or real endorsement, use your own footage and real customers. Tell us and we will build around them.
Ownership and licence
Your material stays yours. Everything you send us remains your property.
The finished ads are yours. On full payment, we assign to you all rights we hold in the delivered files, for any purpose, with no time or territory limit and no further fee. Run them wherever you like, for as long as you like.
Our tools stay ours. The prompts, pipelines, templates and internal methods we use to make the work remain ours, and nothing here transfers them.
Portfolio. We will not show your ads as examples of our work without your permission, and we will take them down on request.
Fees and payment
- Fees are what is stated in the quote you accepted. We quote per engagement rather than from a fixed price list, because volume varies enormously between clients.
- Unless the quote says otherwise, invoices are payable within 15 days of issue.
- Prices are exclusive of GST and any other tax, which is added where applicable.
- We may pause work on overdue accounts after telling you first.
Turnaround and revisions
Typical renders complete in three to five minutes, and a first set usually reaches you the same working day. Those are the times we normally achieve, not guarantees — queue depth, brief complexity and provider availability all affect them.
Revisions included in your engagement are set out in the quote. Re-rendering a hook, a voice, a scene or an end card is normally quick; a change of product, offer or audience is a new brief.
Things you may not do
- Ask us to produce ads for anything illegal, or for categories Meta prohibits.
- Ask us to impersonate a real person, brand or organisation, or to generate a likeness of someone who has not consented.
- Ask us to fabricate reviews, ratings, endorsements, results or credentials. We will decline.
- Present generated performers as genuine customers giving genuine testimony.
- Resell our production service as your own without written agreement — agencies are welcome, but on an agreed basis.
What we don't promise
We promise to produce the work described in your quote with reasonable skill and care. We do not promise commercial results.
No one can honestly guarantee that a specific ad will perform, convert, or be approved by Meta's review system. Anyone who does is guessing. Advertising outcomes depend on your offer, your pricing, your audience, your landing page and the auction — most of which sit outside our control.
Liability
Nothing here limits liability that cannot lawfully be limited, including for fraud or death or personal injury caused by negligence.
Subject to that, our total liability arising out of an engagement is limited to the fees you paid us for that engagement, and we are not liable for lost profits, lost media spend, lost revenue or lost data.
Ending the engagement
Either of us may end an ongoing arrangement with 14 days' written notice. You pay for work completed and work in progress up to that date; see the refunds and cancellation policy for how that is calculated.
We may stop work immediately if you ask for something in the "things you may not do" list above.
Governing law
These terms are governed by the laws of India. The courts at Prayagraj, Uttar Pradesh have exclusive jurisdiction over any dispute, and we both agree to try to resolve matters by discussion before either of us goes there.
